Court likely to rule Monday on Prakitpao’s detention

The Criminal Court looks set to rule on Monday whether Dr Prakitpao Thomthitchong was illegally held at Srithanya Hospital last month.

On Monday, the last witness in the case – Lt-Colonel Thirasak Pinyo of the 191 Emergency Police Unit – will testify to the court. He was seen at the hospital on February 20, allegedly to ensure that Prakitpao was still there.

Thirasak, who knows Prakitpao’s brother Prakitphan, also helped send a police team to escort Prakitpao to the hospital.

Prakitpao, 37, ran a lucrative tutorial business until he was sent to the hospital as a mentally disturbed patient on February 19 under murky circumstances.

An hour before that, he was preparing to sign divorce papers.

Yesterday, the court heard all other witnesses.

Testifying in an open hearing were Prakitphan, Prakitpao’s wife Alisa, his close female friend Pemmika Veerachatraksit, Lt-Colonel Thitidej Intornpan of Bang Sue Police Station, Thitidej’s subordinate Lieutenant Isoon Intorn, Srithanya Hospital’s director Dr Kiatipoom Wongrajit and hospital-patient attendant Anuwat Janprathet.

Testifying in a secret hearing were two doctors who treated Prakitpao: Dr Paitoon Samudsin of Srithanya Hospital and Dr Duangta Kraipaspong of the Galaya Rajanagarindra Institute.

Lt-Colonel Thitidej investigated Prakitpao’s admission to Srithanya on February 20 after Pemmika lodged a complaint, saying that Prakitpao called her for help. Anuwat confirmed that Prakitpao borrowed his cell phone to make a call.

Thitidej then asked the court to order the release of Prakitpao on grounds that he was being detained at the hospital illegally. The court acted on his request and started the emergency hearing last Friday.

During the second day of hearing yesterday, the court also questioned Kiatipoom as to why the hospital failed to register Prakitpao as a patient in its computer system when Thitidej checked the matter on February 20, despite the fact that Prakitpao had been admitted at 10.47pm on February 19.

Kiatipoom explained that it was possible hospital staff had yet to key the patient’s information into the computer, adding he did not order an investigation into the matter because he did not see this as an irregularity, but negligence.

Upon the court’s order, Prakitpao has now been put under the care of the Galaya Rajanagarindra Institute since last Friday. The court asked the institute to give Prakitpao a comprehensive check-up, examining his mental state in detail and checking for any mind-altering substances in his body.

When he was first admitted to Srithanya Hospital, Prakitpao was found to have ephedrine in his body at 200 times the normal level. It remains unclear how this amount of the drug got into Prakitpao’s body.

Pemmika, 24, yesterday told the court that she and her friends were with Prakitpao on February 18, until 9am of February 19, when Prakitpao left to sign the divorce papers.

“He drove by himself. Had he had such a high level of ephedrine while he was with us, he would not have been able to drive,” she said.

However, Prakitphan and Alisa said Prakitpao had acted abnormally only in recent months.

Alisa said she was on a 10-day overseas trip when Prakitpao was sent to Srithanya Hospital, because she felt hurt that he had changed so much.

Alisa and Prakitpao first met while they were students at Triam Udom Suksa School. They married in 1992, and have two children.

Previously, speaking to media, Pemmika and Prakitpao’s family made thinly-veiled allegations that the other party was to be blamed for Prakitpao’s change for the worse.

Pemmika said shares of profits from the tutorial business could have led to family conflicts, while Prakitpao’s family suggested that Prakitpao was a victim of bad influence from friends.

The court yesterday ordered Pemmika, Kiatipoom, Thitidej and Prakitpao’s family members not to hold any press conferences or otherwise attempt to influence the court’s decision.
